Agreement to Terms

By downloading, installing, or using Focus Bender, you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the app.

License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Focus Bender for your personal, non-commercial use.

Subscriptions

Focus Bender Pro Subscription

• Service: Focus Bender offers an auto-renewable subscription called "Focus Bender Pro"
• Product ID: com.lokum.focusbender.pro.monthly
• Duration: Monthly subscription (renews every 30 days)
• Price: $4.99 USD per month (price may vary by region)
• Free Trial: 7-day free trial for new subscribers
• Features: Access to all 5 focus training levels (Level 2+), unlimited practice sessions, detailed progress tracking, and achievement system

Subscription Terms

• Payment will be charged to your Apple ID account at confirmation of purchase (after 7-day free trial)
• Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price
• You can manage subscriptions and turn off auto-renewal in your Apple ID Account Settings after purchase
• Any unused portion of a free trial period will be forfeited when you purchase a subscription
• The free trial is available only once per Apple ID

Cancellation & Refunds

• Cancel Anytime: You can cancel your subscription at any time through your Apple ID Account Settings
• No Partial Refunds: Cancellation of the current active subscription period is not allowed - you will continue to have access until the end of your current billing period
• Auto-Renewal: To avoid being charged for the next period, cancel at least 24 hours before your renewal date
• Access After Cancellation: After cancellation, you'll retain Pro access until the end of the current billing period, then revert to the free version (Level 1 only)
• Refunds: Refunds are handled by Apple according to their refund policy. Contact Apple Support for refund requests
• Trial Cancellation: You can cancel during the 7-day free trial without being charged. Access to premium features will end immediately upon cancellation during the trial

Free Version

Users without an active subscription can access Level 1 of focus training for free with no time limit. This allows you to experience the app's core functionality before deciding to subscribe.

Use of the App

You agree to:

• Use the app in a safe environment where you can maintain awareness of your surroundings
• Not use the app while driving, operating machinery, or in any hazardous situation
• Comply with all applicable laws and regulations
• Not attempt to reverse engineer, modify, or distribute the app

Face Tracking Technology

Focus Bender uses Apple's TrueDepth camera for eye gaze tracking. You understand and agree that:

• Face tracking is used only for real-time focus detection
• No face data is stored or transmitted
• Face tracking can be stopped by pausing or exiting a session
• The app requires camera permission to function

Health and Safety

Focus Bender is designed to help improve focus and attention. However:

• The app is not a medical device or treatment
• Do not use as a substitute for professional medical advice
• Consult a healthcare professional if you have concerns about ADHD or attention disorders
• Take regular breaks during extended use

Intellectual Property

All content, features, and functionality of Focus Bender are owned by us and are protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or create derivative works of the app
• Reverse engineer or attempt to extract source code
• Remove any copyright or proprietary notices
• Use the app for commercial purposes without authorization

Disclaimer of Warranties

Focus Bender is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the app
• Any unauthorized access to or use of our servers
• Any interruption or cessation of transmission to or from the app
• Any bugs, viruses, or other harmful code

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes through the App Store update notes. Your continued use of the app after changes constitutes acceptance of the new Terms.

Termination

We may terminate or suspend your access to the app immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the app will immediately cease.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in California.
